Local authority liability for pavement trip and section 58 Highways Act 1980?

local authority claim to have no liability for pavement trip saying that as they had identified risk and placed order for remedial work section 58 of tne Housing Act 1980 absolves them enen though my accident occurred before work carried out and they had teken no temporary measures to make obstacle safe .
